Welcome to Elonky! This Seller Agreement (“Agreement”) sets out the terms and conditions under which you (“Seller” or “You”) sell products by opening a store on the Elonky platform (“Platform”). To become a seller, you must create an account on Elonky and keep your information up to date. The information you provide must be accurate, current and complete. You cannot transfer or sell your account to another person.

You warrant that your sales activities comply with all applicable laws, such as consumer protection, e-commerce, tax, intellectual property and product safety. You are solely responsible for the legal compliance of your products and business operations.

You must not trade products that are prohibited for sale on Elonky. Our banned products policy contains a detailed list of these products and the items that are prohibited for sale. Elonky applies a listing fee/commission structure for products sold on the platform. Fees are subject to change and sellers will be notified in advance of any changes.

Elonky cooperates with third-party payment processors to facilitate payment transactions. Merchants will receive the proceeds from their sales, net of deductions, through the payment method they have linked to their account.

Sellers are responsible for identifying and paying any taxes that may apply to their sales. Elonky can assist in calculating and collecting taxes, but the ultimate responsibility lies with the seller.

Sellers are responsible for the packaging and timely shipment of their products. In the event of any delay or failure in delivery, the Buyer and Elonky must be contacted immediately.

Shipping costs are determined by the Seller. Sellers may include shipping costs in the product price or set them separately.

For international sales, sellers are responsible for compliance with customs regulations, import duties and other tariffs.

Sellers selling on the Elonky platform must set their own return and exchange policies for each store. Sellers must clearly indicate the conditions under which their products can be returned, the return period and the exchange conditions in their stores. Sellers agree to comply with the minimum return and exchange rules set by Elonky for certain product categories. In particular, returns must be accepted for products that are mandatory to be returned under consumer rights (e.g. defective products).

Sellers must respond quickly when a return request is received and process returns smoothly. The rules on how shipping costs will be covered during the return process must be clearly stated by the seller. The seller must initiate the refund after receiving the returned product from the buyer upon approval of the return request.

Sellers must serve their customers in a prompt and professional manner. You agree to resolve any issues with buyers in good faith.

Where a dispute arises between a Buyer and a Seller, Elonky may mediate the dispute but the final resolution shall be between the Buyer and the Seller, unless otherwise determined by Elonky.

By listing your products, you grant Elonky a free, worldwide license to use, modify and display your product listings for promotional purposes.

You agree not to infringe the intellectual property rights of others. If a third party notifies Elonky of an infringement, Elonky may remove your postings and take other steps as deemed appropriate.

You may terminate your seller account at any time by notifying Elonky. However, you are required to fulfill any outstanding orders.

Elonky reserves the right to suspend or terminate your seller account for violations of this Agreement, illegal activity, or any other reason deemed appropriate by Elonky.
